A 28-year-old man has been arrested in Tulsa after he was accused of sending explicit text messages to a minor under the age of 16 and kissing her in "secluded" areas of the church where he was a Sunday School teacher.Timothy Maxey Gregston of Oolagah was arrested at his job earlier this week. Investigators say Gregston had known the girl for quite some time because the two attended the same church. They say that he began exchanging emails and text messages, some of which were sexually explicit. At least one email Gregston allegedly sent the girl was a lewd photo of himself.Police say the man invited the girl to remote areas of the church on three occasions and kissed her.Gregston was charged Tuesday in Rogers County District Court with four felony counts, including three counts of Lewd Acts to a Child Under 16 and one count of Lewd or Indecent Proposals to a Child Under 16.Lewd or Indecent Acts or Proposals to a Child Under 16 is defined in the Oklahoma criminal code in 21 O.S. 1123. Some of these prohibited acts are subjective in their interpretation, including the stipulation that it is a felony to "look upon . . . any child under sixteen . . . in a lewd and lascivious manner."The specific portions of the statute which Gregston is charged with violating, according to court records, are as follows:

  • 21 O.S. 1123 (A)(2) - It is a felony for any person to knowingly and intentionally look upon, touch, maul, or feel the body or private parts of any child under sixteen (16) years of age in any lewd or lascivious manner by any acts against public decency and morality, as defined by law.
  • 21 O.S. 1123 (A)(5)(c) -It is a felony for any person to knowingly and intentionally in a lewd and lascivious manner and for the purpose of sexual gratificationcause, expose, force or require a child to look upon the body or private parts of another person.
  • 21 O.S. 1123 (A)(5)(f) -It is a felony for any person to knowingly and intentionally in a lewd and lascivious manner and for the purpose of sexual gratification force or require a child to touch or feel the body or private parts of said child or another person.

Lewd acts with a minor is punishable by 3 to 20 years in prison. It is a Level 3 sex offense, requiring anyone convicted to register as a sex offender for life, providing address verification to law enforcement every three months.Being accused of a sex crime, particularly a sex offense involving a minor or a child, can have a devastating effect on one's life.
