Child Porn Task Force Nets Two More Arrests

[caption id="attachment_2083" align="alignleft" width="300"]oklahoma criminal lawyer Image Credit: Public Domain[/caption] The Oklahoma Internet Crimes Against Children Task Force has two more notches in its gun belt this week after an Oklahoma City man and a Norman man were arrested for allegedly distributing child pornography to an undercover Guthrie police officer. On Monday, investigators with the Oklahoma Attorney General's Office arrested David Edward Kennedy, 26, of Norman. They accuse Kennedy of distributing several videos containing child pornography to the undercover officer. He was arrested on complaints of distributing pornography and violating the Oklahoma Computer Crimes Act. Warrants were served at both Kennedy's home in Norman and his former home in Oklahoma City, and computer items from both residences were sent to the Oklahoma State Bureau of Investigation (OSBI) Computer Crimes Unit for analysis. The OSBI Computer Crimes Unit will seek to determine the number of illicit images and videos on the devices and will attempt to identify any victims. Yesterday, the OSBI arrested 19-year-old Zachary Ray Aldridge at his home in Oklahoma City. The Guthrie police officer serving as an undercover agent of the Oklahoma Internet Crimes Against Children Task Force accused Aldridge of sending "several thousand" child pornography images and videos. A computer storage device was sent to the OSBI Computer Crimes Unit, and police say it contained thousands of pornographic images of children. Investigators say they do not believe that any of the images were of local children. Of interesting note is that, although the age of legal consent in Oklahoma is 16, child pornography is defined as sexual visual depictions of a person under the age of 18. Theoretically, the images for which Aldridge was arrested could contain girls less than two years younger than he is. The Oklahoma statutes define explicity child pornography in  21 O.S. §1024.1: . . . "child pornography" means and includes any visual depiction or individual image . . . wherein a minor under the age of eighteen (18) years is engaged in any act with a person, other than his or her spouse, of sexual intercourse which is normal or perverted, in any act of anal sodomy, in any act of sexual activity with an animal, in any act of sadomasochistic abuse including, but not limited to, flagellation or torture, or the condition of being fettered, bound or otherwise physically restrained in the context of sexual conduct, in any act of fellatio or cunnilingus, in any act of excretion in the context of sexual conduct, in any lewd exhibition of the uncovered genitals in the context of masturbation or other sexual conduct, or where the lewd exhibition of the uncovered genitals, buttocks or, if such minor is a female, the breast, has the purpose of sexual stimulation of the viewer, or wherein a person under the age of eighteen (18) years observes such acts or exhibitions. In addition to being a state offense, child pornography is a federal offense described under 18 USC § 2251 dealing with the sexual exploitation of children and defined under 18 USC § 2256. In Oklahoma, possession of child pornography is a felony punishable by a maximum of 20 years in prison and a fine of up to $25,000 on the first offense. Possession of child pornography is a Level 1 sex offense, and anyone convicted must register as an Oklahoma Sex Offender for a period of 15 years and must provide annual address verification to comply with registration requirements. If a person is convicted of a second sex offense, he or she is deemed a "habitual offender," and becomes a Level 3 Sex Offender who must register for life and provide address verification every three months.
