Effective November 1st, 2007, drastic changes were made pertaining to your obligations and restrictions as a registered Sex Offender. These changes stem from Oklahoma’s adoptions, in part, of the Adam Walsh Child Protection and Safety Act of 2006. In many cases changes include:
- Creating lifetime registration requirements.
- Extremely limiting options for housing and living arrangements.
- SEX OFFENDER on Drivers License.
- Requiring written permission from religious leader prior to attending worship services.
- GPS monitoring for duration of registration period.
- Polygraph examinations.
- Discretional Sexual Deviant Behavioral School
- And the list goes on...
Oklahoma has adopted the 3-tier system of numeric risk assignment; i.e., 1, 2, or 3. In theory these levels represent a predictor of risk a person will reoffend. Level three (3) is reserved for those that pose a serious danger of continuing to engage in criminal sex conduct. In reality, the Risk Assessment Review Committee, established by the Department of Corrections, gives little or no consideration to the individual circumstances of a person’s case before making this life changing determination in many cases relying solely on your original charge.
There is Relief Available.
The law allows that the Risk Assessment Committee, the D.O.C., or a Court may override a risk level if the risk level assessed is not an accurate prediction of offender risk. Is your Assessment Accurate?
