Oklahoma Drug Trafficking

What is Drug Trafficking?

Drug trafficking is the criminal act of possessing, manufacturing, transporting, or distributing illegal narcotics. Illegal narcotics include cocaine, heroin, methamphetamine, LSD, PCP, cocaine-base or “crack,” and ecstasy. Any person who manufactures, transports, or sells controlled substances in the state of Oklahoma can be charged with drug trafficking by law enforcement. In most cases, people who are charged with drug trafficking have been smuggling large quantities of illegal narcotics into or out of the country.

What’s the difference between Trafficking and other drug crimes?

The biggest difference is usually the weight or amount of the narcotics. Oklahoma prosecutors usually file trafficking cases based solely on the amount of narcotics present regardless of whether the person was selling, transporting or distributing the narcotics. For example, below is a chart of narcotics and the respective weights that constitute trafficking.

Drug Type Weight for Trafficking
Marijuana 25 pounds
Cocaine 28 grams
Heroin 10 grams
Lysergic acid diethylamide (LSD) 50 dosage units
Amphetamine or methamphetamine 20 grams
Phencyclidine (PCP) 1 ounce
Cocaine Base or “Crack” 5 grams

What to expect if I’m charged with Trafficking?

Oklahoma law provides severe penalties for Trafficking in illegal narcotics including mandatory prison time (if convicted), steep monetary fines, driver’s license suspension, and forfeiture of assets including money, automobiles, weapons, or anything logically linked to the trafficking of illegal drugs.
